1. About these Terms
1.1. Welcome to nutritionbybec.com.au (the Website), operated by Nutrition By Bec (ABN 91 681 586 916) (Nutrition By Bec, we, us or our).
1.2. The Website provides information about our nutrition and dietetic services, allows you to book appointments and may allow you to purchase digital products and resources (collectively, the Products and Services).
1.3. These Website Terms and Conditions of Use (the Terms) apply to your use of the Website and your purchase or use of our Products and Services.
1.4. By accessing or using the Website, purchasing a Product, or booking or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Website or purchase our Products or Services.
1.5. We may update these Terms from time to time. Any changes will take effect when the updated Terms are published on the Website. The Terms that apply to your purchase or booking will generally be the Terms in effect at the time of that purchase or booking.
2. Our Services
2.1. Nutrition By Bec provides professional nutrition and dietetic services delivered by appropriately qualified nutrition professionals.
2.2. Our Services may include, depending on the service booked:
*individual nutrition and dietetic consultations;
*fertility and preconception nutrition support;
*women’s health nutrition support;
*nutrition assessment and education;
*personalised nutrition recommendations;
*meal planning and practical nutrition support;
*supplement and nutrition review; and
*other services described on the Website.
2.3. The scope of each Service will depend on the service booked and the information you provide during the consultation process.
2.4. Nutrition recommendations are individualised based on the information available to us at the time of your consultation. You are responsible for providing complete and accurate information relevant to your care, including information about your medical history, medications, supplements, allergies, intolerances and other relevant health circumstances.
2.5. You should notify us if your health circumstances change or if you receive new medical advice, diagnoses, medications or treatments that may be relevant to your nutrition care.
2.6. Our Services are intended to complement, rather than replace, appropriate medical care. Where appropriate, we may recommend that you consult with your GP, medical specialist, pharmacist or another qualified healthcare professional.
3. Bookings and Appointments
3.1. Bookings for our Services must be made through the booking system available on the Website or through another booking method approved by Nutrition By Bec.
3.2. By making a booking, you agree to provide accurate and up-to-date information required to arrange and provide the Service.
3.3. Your appointment is confirmed once your booking has been accepted through our booking system.
3.4. Payment arrangements will depend on the Service booked and will be communicated at the time of booking.
3.5. We use Cliniko as our practice management and booking system. When you use Cliniko to make or manage an appointment, your use of the platform is also subject to Cliniko’s applicable terms and privacy practices.
4. Cancellation, Rescheduling and No-Show Policy
4.1. We understand that circumstances can change. However, appointments are reserved specifically for you and late cancellations can prevent another client from accessing that appointment time.
4.2. We require a minimum of 48 hours’ notice to cancel or reschedule an appointment without a cancellation fee.
4.3. Where an appointment is cancelled or rescheduled:
48 hours or more before the appointment:
No cancellation fee will apply.
Between 24 and 48 hours before the appointment:
A cancellation or rescheduling fee equivalent to 50% of the consultation fee may apply.
Less than 24 hours before the appointment, or in the event of a no-show:
The full consultation fee may apply.
4.4. Cancellation fees may be charged using the payment method associated with your booking or may be invoiced to you.
4.5. If you are experiencing an unexpected emergency or circumstances outside your reasonable control, please contact us as soon as possible at hello@nutritionbybec.com.au<ma
4.6. Where Nutrition By Bec needs to cancel or reschedule an appointment, we will provide as much notice as reasonably possible and work with you to arrange another suitable appointment time. Where appropriate, you may request a refund for any prepaid Service that cannot be provided.
5. Packages
5.1. Where you purchase a consultation package, the package includes the number and type of appointments and other inclusions described at the time of purchase.
5.2. All sessions included in a package must be used within six (6) months of the date of purchase.
5.3. Any unused sessions remaining after the six-month period will expire and cannot be redeemed, transferred or refunded, except where otherwise required by the Australian Consumer Law or agreed by Nutrition By Bec.
5.4. It is the client’s responsibility to ensure that all sessions included in their package are booked and used within the six-month period.
5.5. Package appointments are personal to the purchaser and cannot be transferred to another person unless agreed by Nutrition By Bec.
5.6. Purchasing a package does not guarantee a particular health, fertility, weight, symptom, pregnancy or other outcome.
5.7. Where a package is cancelled or a refund is requested, any refund will be considered in accordance with these Terms, the terms applicable to the particular package and your rights under the Australian Consumer Law.
6. Digital Products and E-Products
6.1. We may offer digital products, including e-books, guides, resources, meal planning resources and other downloadable or electronic materials (the E-products).
6.2. By purchasing an E-product, you agree to pay the purchase price displayed on the Website at the time of purchase.
6.3. Unless otherwise stated, prices are displayed in Australian Dollars (AUD).
6.4. Once payment has been successfully processed, you will generally receive access to the purchased E-product using the method described on the Website.
6.5. E-products are provided for personal, educational and informational use unless otherwise stated.
6.6. You must not reproduce, resell, distribute, publish, upload, share publicly, commercially exploit or substantially copy any E-product or its contents without our prior written permission.
6.7. You may not upload our E-products or substantial portions of them to websites, social media platforms, online communities, file-sharing services or other platforms for distribution to others.
6.8. Nutrition By Bec does not provide refunds for change-of-mind purchases of E-products, except where required by the Australian Consumer Law.
6.9. Nothing in these Terms limits or excludes any rights you may have under the Australian Consumer Law.
7. Payments
7.1. Payments may be processed through third-party payment providers available through the Website.
7.2. By making a payment, you agree to comply with any applicable terms and conditions of the relevant payment provider.
7.3. You warrant that you are authorised to use the payment method provided.
7.4. If a payment is declined, reversed or otherwise remains unpaid, we may suspend or withhold access to the relevant Product or Service until payment has been successfully received.
7.5. Any applicable GST will be handled in accordance with Australian taxation requirements.
8. Personalised Nutrition Advice and Health Information
8.1. Nutrition By Bec provides professional nutrition and dietetic advice as part of its Services.
8.2. Nutrition advice is provided based on the information available to us and the circumstances discussed during your consultation.
8.3. Our Services are not a substitute for medical diagnosis, treatment or advice from your treating medical professionals.
8.4. You should continue to follow appropriate medical advice and seek medical attention where required.
8.5. You should contact your GP, medical specialist, pharmacist or other appropriate healthcare professional if you experience symptoms or health concerns requiring medical assessment.
8.6. Where recommendations involve supplements, medications, significant dietary changes or matters outside the scope of dietetic practice, we may recommend that you seek advice from another appropriately qualified healthcare professional.
8.7. We do not guarantee a particular health, fertility, weight, symptom, pregnancy or other outcome. Individual responses to nutrition and lifestyle interventions vary.
9. Artificial Intelligence and Technology
9.1. Nutrition By Bec may use artificial intelligence (AI) and other technology-assisted tools to support the delivery and administration of our Services.
9.2. We currently use AI-assisted technology, including Heidi Health, to assist with clinical documentation and note-taking during consultations.
9.3. Where Heidi is used during a consultation, it may process information discussed during the consultation and generate written notes or summaries to assist your dietitian with clinical documentation and record-keeping.
9.4. Where AI-assisted note-taking or transcription is used during your consultation, you will be informed before or during the consultation. You may ask questions about the use of this technology or raise any concerns with your dietitian.
9.5. AI-generated notes, summaries or other outputs are not automatically accepted as accurate. Your dietitian remains responsible for reviewing and verifying AI-generated outputs and exercising independent professional judgement when determining what information is relevant and appropriate for your care.
9.6. AI technology may contain errors, omissions or inaccuracies. AI-generated information is therefore used as an aid to, and does not replace, the professional judgement of your dietitian.
9.7. Nutrition By Bec remains responsible for the professional decisions made in relation to your care, including the accuracy and appropriateness of clinical notes and recommendations incorporated into your care.
9.8. AI-assisted technology will be used in accordance with applicable privacy laws, professional obligations, informed consent requirements and clinical record-keeping obligations.
9.9. We may use other technology-assisted tools for administrative purposes, such as appointment management, communication, document preparation or other functions that support the operation of our practice.
9.10. Information processed through third-party technology providers may be subject to the terms, privacy policies and security practices of those providers. We take reasonable steps to select and use appropriate technology providers and to protect your personal information.
10. Privacy and Handling of Personal Information
10.1. Nutrition By Bec collects and handles personal information for the purpose of providing and administering our Website, Products and Services.
10.2. The information we may collect includes, depending on your interactions with us:
*your name and contact details;
*booking and appointment information;
*payment and transaction information;
*information you provide through forms or questionnaires;
*health and medical information relevant to your care;
*information about medications, supplements, allergies and dietary requirements;

10.5. We use third-party service providers to support our business operations. These may include providers of practice management and booking systems, payment processing, email, website hosting, cloud storage, clinical documentation, transcription and AI-assisted technology.
10.6. We use Cliniko for practice management, appointment scheduling, client records and related administrative functions. Information entered into Cliniko may be processed by Cliniko and its third-party service providers in accordance with Cliniko’s terms and privacy practices. Cliniko’s Terms of Service state that data may be transferred to third-party IT providers outside Australia.
10.7. We use Heidi Health to assist with AI-supported clinical documentation and note-taking during consultations. Information discussed during a consultation may be processed through Heidi where this technology is used.
10.8. Heidi’s current Usage Policy states that healthcare providers are responsible for ensuring their use of the platform complies with applicable privacy laws, informed consent requirements, record-keeping obligations and professional standards. It also requires healthcare providers to independently review and verify AI-generated outputs before relying on them for clinical decision-making or patient care.
10.9. Depending on the third-party services we use, your information may be stored or processed in Australia or overseas. Where this occurs, we take reasonable steps to use providers with appropriate privacy and security practices.
10.10. We may disclose personal information where reasonably necessary to provide our Services, including to relevant service providers, healthcare professionals involved in your care where appropriate and authorised, or where disclosure is required or permitted by law.
10.11. We do not sell your personal or health information to third parties.
10.12. We retain client and health information for the period required by applicable Australian laws, regulations and professional record-keeping obligations.
10.13. We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, modification or disclosure. However, no electronic storage or transmission system can be guaranteed to be completely secure.

11.5. We do not guarantee that the Website will always be available, uninterrupted, error-free or free from viruses or other harmful components.
12. Australian Consumer Law
12.1. Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law where those rights cannot lawfully be excluded, restricted or modified.
12.2. Our Products and Services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
12.3. Where a Product has a major failure, you may be entitled to a replacement or refund and compensation for any other reasonably foreseeable loss or damage.
12.4. Where a Service has a major failure, you may be entitled to cancel the Service and obtain a refund for the unused portion, or compensation for its reduced value.
12.5. Where permitted by law, we may choose to provide a remedy for a minor failure in accordance with our legal obligations.

To the extent permitted by law, our liability in relation to a Product or Service will be limited to the remedies available under applicable law and, where the law permits us to do so, the resupply of the relevant Product or Service or the cost of having the relevant Product or Service supplied again.

18.1. These Terms are governed by the laws of New South Wales, Australia.
18.2. You agree that any dispute arising in connection with these Terms will be subject to the jurisdiction of the courts of New South Wales, subject to any rights you may have under applicable consumer protection laws.
