Website Terms and Conditions of Use – Nutrition By Bec About the Website 

1.1. Welcome to nutritionbybec.com.au (the ‘Website’). The Website provides you with an opportunity to browse and purchase e-products (collectively the ‘Products’) and book services (‘Services’). The Website provides this service by granting you access to the content on the Website (the ‘Purchase Services’).

1.2. The Website is operated by Nutrition By Bec (ABN: 91 681 586 916), trading as Nutrition by Bec. Access to and use of the Website, or any of its associated Products and Services, are provided by Nutrition by Bec. Please read these terms and conditions (the ‘Terms’) carefully. By using Browse, and/or reading the Website, this signifies that you have read, understood, and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of its Services, immediately.

1.3. Nutrition by Bec reserves the right to review and change any of the Terms by updating this page at its sole discretion. Any changes to the Terms take immediate effect from the date of their publication.

Acceptance of the Terms You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Nutrition by Bec in the user interface. 

Bookings and Cancellations for Services

2.1. Nutrition by Bec requires all bookings for the Services to be made via the booking system provided (the ‘Booking System’).

2.2. If you choose to create an account with the Booking System, you acknowledge and agree to be bound by the Terms and Conditions of Use, Privacy Policy, and other relevant legal documentation provided by the Booking System.

2.3. Once you have made a booking for the Services, you will be required to make payment of the purchase price (‘Purchase Price’).

2.4. Cancellation Policy: We kindly ask for a minimum of 48 hours’ notice if you need to cancel or reschedule your appointment. This helps us offer the spot to someone on our waitlist who is also seeking support.

• Changes made within 24–48 hours of your scheduled consultation may incur a fee equivalent to 50% of your consultation cost.
• Cancellations, reschedules, or no-shows with less than 24 hours’ notice will incur the full consultation fee.
• We understand that life happens and emergencies do come up.

Purchase of E-products 

3.1. In using the Purchase Services to purchase the Products through the Website, you will agree to the payment of the Purchase Price listed on the Website for the Products.

3.2. Payment of the Purchase Price may be made through debit card and credit card through the available payment gateway providers (the ‘Payment Gateway Providers’).

3.3. In using the Purchase Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy, and other relevant legal documentation provided by the Payment Gateway Providers.

3.4. Following payment of the Purchase Price being confirmed by Nutrition by Bec, you will be issued with a receipt to confirm that the payment has been received,d and Nutrition by Bec may record your purchase details for future use.

3.5. You acknowledge and agree that where a request for the payment of the Purchase Price is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Purchase Price.

3.6. Unless otherwise stated, all amounts are listed in Australian Dollars (AUD) and are GST exclusive.

Refunds and Returns Nutrition by Bec does not provide change-of-mind refunds for E-products. Please keep this in mind when making a purchase. 

Warranty 

4.1. E-products: Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure of the Product and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure (the ‘Warranty’). A major failure is when a product is significantly different from its description, unsafe, or unfit for its normal purpose.

4.2. Services: Nutrition by Bec will use its best efforts to help you achieve your desired results. However, we make no warranty that all clients will achieve the same results. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your agreement with Nutrition by Bec and are entitled to a refund for the unused portion, or to compensation for its reduced value.

AI and Machine Learning Technologies 

5.1. Use of AI Technologies: Nutrition by Bec may use artificial intelligence (AI), machine learning algorithms, and automated technologies to enhance our Services and Products, including but not limited to content creation, meal planning recommendations, nutritional analysis, customer support functions, note-taking during consultations, and other administrative purposes.

5.2. AI Note-Taking and Transcription: During consultations, Nutrition by Bec may use AI-powered tools (including but not limited to Heidi) for note-taking and transcription purposes. These tools transcribe spoken words in real-time to create written notes and transcripts. No audio recordings are saved during this process – only text transcripts and notes are stored for as long as necessary for your care and our record-keeping requirements. By participating in consultations, you consent to this AI-assisted note-taking process.

5.3. AI-Generated Content: Some content provided through our Website, Services, or Products may be generated or assisted by AI technologies. While we strive to ensure accuracy and quality, you acknowledge that AI-generated content may contain errors, inaccuracies, or limitations. All AI-generated content should be considered supplementary to, and not a replacement for, professional nutritional advice.

5.4. Data Processing: By using our Services, you consent to the processing of your information through AI and machine learning systems for the purpose of providing personalized recommendations, note-taking, transcription, and improving service quality. This processing is conducted in accordance with our Privacy Policy.

5.5. AI Limitations: You understand and acknowledge that AI technologies have inherent limitations and may not always produce perfect results. Nutrition by Bec disclaims any liability for decisions made based solely on AI-generated recommendations without proper professional consultation.

5.6. Human Oversight: All AI-generated nutritional advice and recommendations are subject to human oversight by qualified nutrition professionals. However, you remain responsible for verifying any AI-generated content with appropriate healthcare providers before implementation.

Disclaimers 

6.1. Products Disclaimer: You agree that when you purchase a Product, you are solely responsible for creating and implementing your own physical, mental, and emotional well-being, decisions, choices, actions, and results. As such, you agree that Nutrition by Bec is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any Products it provides. You understand that the Products are not a substitute for medical attention, examination, diagnosis, or treatment, and it is your exclusive responsibility to seek independent professional guidance as needed.

6.2. Services Disclaimer: You understand that the Services are not a substitute for medical attention, examination, diagnosis, or treatment. Additionally, the Services are not to be used as a substitute for professional psychology, psychiatric, or other mental health care. It is your exclusive responsibility to seek such independent professional guidance as needed.

Limitation of Liability 

9.1. Nutrition by Bec’s total liability arising out of or in connection with the Purchase Services or these Terms will not exceed the most recent Purchase Price paid by you. Where you have not paid the Purchase Price, then the total liability of Nutrition by Bec is the resupply of information or Purchase Services to you.
